Carrick McFetridge, Lula's husband, had a life insurance policy for $430. When he died in1944, the insurance company claimed that there had been a mistake on the policy: that it should have been written for $230. Because Lula & Carrick were illiterate, the insurance company faulted them for not noticing that a policy on a 48-year-old man could not be written for more than $230. (2 copies of case)

The suit was brought on behalf of the Lenoir Manufacturing Company by the plaintiff insurance companies to recover amounts paid by them for the loss of personal property charged to have been burned by sparks from the defendant's engine as the result of the defendant's negligence.
