A.S. Kerr sued out a civil warrant to collect a debt against L.M. Johnson. J.M. Raines, constable of Madison County, was responsible for executing the warrant and collecting the account. Raines collected a judgment of $24.65 and only paid Kerr $20.00, with Raines keeping $4.65. Raines claimed Kerr promised to pay him outside of his costs also, but Kerr denies this.
