L. Podesta & Co. consisted of L. Podesta and his partner, H. Malatesta. Suit by Podesta & Co. against A.J. Hathcock and brother M. Hathcock was dismissed against M. Hathcock, but because A.J. Hathcock was unable to attend court, judgment was issued against him. This case appeals that ruling on account of no business being conducted between the Hathcocks and Podesta & Co.
