Under terms of plaintiff's policy with defendant he would be paid $25 per week for life if permanently disabled. On 3 March 1930 plaintiff accidentally injured himself by drinking a small amount of "Jamaica ginger" that contained a "foreign or poisonous" ingredient & suffered "multiple neuritis", resulting in permanent disability.
