Whitzel went to Chattanooga after being hired on probation as a canvasser. He came to like the city and wished to moved his family there from Kansas. He was then let go and sued. A complication arose after the jury announced its verdict in Whitzel's favor. Two jurymen, C. R. Buford and B. F. McGill, told the court that the decision had not been unanimous even though they were believed to have voted with the majority so they could go home. |

The defendants owned a drug store in Chattanooga that they wanted to sell and entered into a contract with the plaintiffs to sell their store to Wilford Bright and pay the plaintiffs $300. Bright was dissatisfied with the price and backed out of the deal but Sheridan sued to recover the $300 from Dowler anyway. |
