McClanahan, plaintiff, had obtained judgments against E.E. Ellis for $106. P.A. Hodges, constable, was executor of judgment and levied Ellis's property and advertised them. During this time, William Massengill, agent of John S. Coile sued against McClanahan. In previous court Coile won against McClanahan. McClanahan claims proceedings were illegal because he was taxed by Thomas R. Dodson with payment of costs of attachment or injunction and his money collected against Ellis was detained by Hodges. |
