Def. in error was the owner of a two story frame shingle roof home situated on the north side of Market Street in the town of Fayetteville, TN and insured against fire by the pla. in error. Said home was destroyed by fire on March 27, 1890. Def. now states pla. refuses to make payments. Pla. claims a tornado caused the initial damage which led to the fire and believes this releases them from liability. Also see "The London and Lancashire Fire Insurance Co. v. C. A. On the third day of November 1863 Joseph Sebastian, dec. died with an intact will. Whitaker and Sebastian were named executors. Sebastian's widow married William Spencer, jr. The estate included an enslaved woman, Ann, and her children who had been sent to Nancy Sebastien before her father's death. The suit was filed in order to fulfill a bequest that would equal the value of the enslaved people. |

In 1885, the plaintiff held the legal title to a house and lot and purchased a policy in 1887 from another insurance company (not defendant) that insured the plaintiff against loss or damage by fire. In 1888, the plaintiff transferred his policy to the defendant, who added on certain conditions. Later that year, the plaintiff's house burned down by no fault of his own or by violating any conditions listed in his policy, as the defendant accuses and refused to cover the policy. |

Gillespie also spelled Gillispie. Acting as an agent for Scribner and Sons of New York City, Gillespie sold a book titled "Stanley's Darkest Africa," throughout the town of Fayetteville. Plaintiff claims that he was originally told that he was not liable for State and County taxes, but upon delivery of the books, the plaintiff was informed that he owed a privilege tax. Plaintiff refused to pay and the books were seized. |

Opinion only. 60 years before, William Crawford had set aside 1 acre of his farm as a family cemetery where he was buried. His descendants also used it as a burial ground and were buried there too. The question in the opinion was whether the prosecutor and other descendants of Crawford had a right of easement of burial in the cemetery and for purposes of visiting and repairing the graves. Judge believed they had these rights and did not injure the owner of the farm. |
