Rebecca McNew was formerly Rebecca Pack. In 1838, Rebecca Pack bought a tract of land from Tobey, with $20 payment. At the time of sale, defendant led plaintiff to believe tract contained 20-30 acres (at $1.50/acre). Plaintiff stated she paid $11 later. Defendant refused to give title, and had informed Rebecca that she had to surrender the land. |

Bell cited to court on warrant issued against Bell & Smith in favor of John Russell. Bell knew nothing of the debt, which seemed to be predicated on note signed "Bell & Smith" in handwriting of B.S. Smith, Bell's former partner. Though Bell thought the debt to be unjust, he paid half of it (to avoid litigation), with the rest to be paid by Smith. But Smith got his brother-in-law Cox to delay execution & when the delay was over, Smith was broke. Cox paid the balance & then sued Bell. |
