After King built dam, it threw water on old road so Baker could no longer cross it, so Baker removed fence he had previously built on land & built a new road. Proffit then built fence on the land. McClanahan, plaintiff, had obtained judgments against E.E. Ellis for $106. P.A. Hodges, constable, was executor of judgment and levied Ellis's property and advertised them. During this time, William Massengill, agent of John S. Coile sued against McClanahan. In previous court Coile won against McClanahan. McClanahan claims proceedings were illegal because he was taxed by Thomas R. Dodson with payment of costs of attachment or injunction and his money collected against Ellis was detained by Hodges. |

William Hixon asks mortgage to be foreclosed, the land and Negro sold, and the proceeds applied to mortgage debt. Does not want Pleasant Hixon to collect any amount for purchase of land or Roberson to pay for said land. |
