Grace and Hugh Cain were the adult children of the late Hugh Cain who died in 183[?] and left a substantial estate. It included slaves (all named) that he manumitted in his will. Son Hugh administered his father's estate and swindled Grace by calling a lunacy inquest. Grace charged that her brother kept her in a poor condition, ill-treated her, and "laid violent hands upon her." Copy of the will is in evidence. Elijah Russell was Grace's brother-in-law. The slaves had yet to be freed in 1857.

Case also involves a debt dispute.

Two suits tried together, the object of both being to ascertain which party is lawfully the surveyor of Washington County & therefore entitled to books & papers of that office. Madison Booth elected surveyor in May 1852, but resigned in August 1855. At special election, Ephraim elected to fill out Booth's unexpired term. At May 1856 election, Ephraim & Joseph were both candidates, but Joseph won. Nevertheless, Ephraim appeared at July term of court & had his surveyor bond approved. Ephraim won.

Additional Plaintiffs: John Shute and S.E. Gilleland.

The John, Elizabeth and Cornelia are the heirs to Samuel Wilson's estate. They were minors and the land was lost due to debt. The plaintiff wishes to redeem the land.

Debt dispute is over a horse.

Additional Plaintiffs: James Mullins and B.M. Tillman.

Trespass with damages of $400. Both parties were indebted to each other, but the defendant allegedly attempted to defraud the plaintiff into paying more money than was actually owed to him.
