In 1927 plntff. took out a policy with the deft. that would pay him $1100 should he become permanently disabled due to accident or illness before reaching the age of sixty. Plntff. has since developed a number of serious illnesses, but deft. has refused to pay. Deft. argues that plntff. has failed to provide it with any proof of disability as defined by the contract.
