Plaintiff, who had a policy with the defendant, sued to collect $25 in unpaid claims plus a 25% penalty. Plaintiff also had policies with 3 other insurance companies & had filed claims with all of them. Defendant argued that her carrying aggregate insurance of over $7 violated her policy contract with them, & under the terms of the contract they were liable for only the pro rata part. Defendant had paid some of her claims before learning of the other insurance policies.

O. W. Helms was driving a car while on business for Cosmopolitan Life Insurance Company when he struck and killed Allen Jordan, of whose estate Mattie Sharp is the administratrix. Helms abandoned the car and reported it stolen. Jordan had been living with and supporting Sharp while married to Maud Colvin. Cosmopolitan attempts to absolve themselves by stating they do not require their employees to travel by car.

Plaintiff, who holds a $1500 insurance certificate with def.., is sued def.. to recover this amount. Plaintiff states that he is permanently disabled & unable to work due to "bronchial trouble, lung trouble, tuberculosis of the lungs" & other diseases. He has proven his illness & disability to the deft. in accordance with the terms of the policy, but deft. has refused to pay. Deft. argues that the claim was denied because the policy had not been continuously in force for 1 year as required.

Plaintiff Hickman Jones, an African-American female, sued to recover monies paid defendant on insurance premium. Charfes defendant deliberately misrepresented its policies & benefits. Jones took out insurance on her boarder, Kelly Coachman, having been misled into believing that she would receive his death benefits. Suit arises from company informing her that she has no "insurable interest". Hickman unrelated to Coachman. In applying for policy she claimed to be his cousin.

View Entry 1935 Provident Accident & Life Insurance Company v. Mrs. Emma Wolfe Hamilton Insurance Disputes

Amsy Wolfe died from a head wound sustained in a fall. Emma claimed that a basal skull fracture caused death, but 2 doctors testified that the gash was not fatal. After Amsy was in the casket, the doctors again examined his head. They found a depression near the base of the skull but could not say if it was natural or the result of a severe blow. Testimony: J. M. Payne, W. A. Randall, J. A. Renow, A. S. Jones, C. D. Farris, Arthur Wolfe & Drs. Armstrong McAfee & Ed Newell. Published writ of certiorari.
