Rebecca McNew was formerly Rebecca Pack. In 1838, Rebecca Pack bought a tract of land from Tobey, with $20 payment. At the time of sale, defendant led plaintiff to believe tract contained 20-30 acres (at $1.50/acre). Plaintiff stated she paid $11 later. Defendant refused to give title, and had informed Rebecca that she had to surrender the land. |

Dispute arose when Dr. Alexander Williams (now dec.) claimed part of 2-acre tract was his. Both Wrights & Dr. Williams claim title through original land grants to James Patterson. This was in May 1865. In 1868, the land was decreed to be sold. Westmoreland claimed to have commenced an action on the original attachment 10 days before Arnold. |
