View Entry 1845 John Den, lessee of Jeriel Dodge & John Bowman v. John Hodges, et al. Washington Land and Title Dispute

Add. Defs: Howell A. Hodges, Jesse Duncan. Dodge & Bowman leased to Den (to farm) several tracts of land near or on Watauga River & Holston River, including tract with ferry formerly known as Duncan's Ferry. Den ejected & filed suit for $500 damages. John Hodges lived on land. Duncan was "an old man" who "had no family" & lived with John "as one of his family." Howell (John's son), lived on & farmed another part of the land. Dodge & Bowman died while suit pending; their admrs. continued the suit.

Add. plaintiffs: James Samples, John Samples, & Melinda Samples. John Samples, Sr. (dec.) lived on a parcel of land that he willed to his children, the majority going to Jane as she already lived on the property. Defendant claims he holds rights to the timber and crops on the land due to a boundary issue.

Add. plaintiff: R.A. Brown & John Den. Plaintiffs contracted a tract of land to a said Den for ten years. However, Ellis states that a majority of the property was theirs and forcefully ejected Den from his property. Filed for damages of $500.

Jack & McAllister got judgments against Hamilton (as did 2 others) & all 4 judgments were satisfied by selling Hamilton's land, at which sale Jack & McAllister purchased the land. Dispute over effect of Hamilton's possession on title of Jack & McAllister. Land at issue bordered Nolichucky River & included the William Anderson tract & the Soldiers Rest tract.

Add. plaintiffs: T.W. Harris, O.A. Nixon, August Richard, & J.H.M. Ador. Add. defendants: Stephen Hardlin, J.P.Y. Whitfield, G.B. Wilson, Henry Trich, & George K. Hosford. Plaintiffs claim that Patterson has no claim to a tract of land he resided on and argue that a contract they entered entitles them to compensation for what the sale of the land would total.

View Entry 1852 John Den, lessee of Henderson Clark v. Montgomery Stuart, admitted to defend in lieu of Thompson Stuart Washington Land and Title Dispute

Clark leased to Den 20 acres on Nola Chuckey River (including small island & fish trap), which land Clark claimed through July 1842 TN grant to him (#24711), which Stuart also claimed through Oct 26, 1786 NC grant to Cornelius O'Neal (#748). After trial began, pla. replaced original def Thompson Stuart with Montgomery Stuart. Land at issue surveyed by county surveyor Madison Booth. Jury ruled in Clark's favor.

View Entry 1869 James Lay v. William R. Bashears Scott Land and Title Dispute

Lay sued Bashears over title to land. Jury ruled in Lay's favor. Dispute relates to land shown in survey plat, with the following grant & entry numbers: TN land grants (per survey plat): Edward Baker, 125 acres, grant no. 20512, entry no. 74; Wm Byrd, 200 acres, grant no. 27168, entry no. 711; D. Shoopman & J. Owen, grant no. 25595, entry no. 906. Additional documents may be found in ET 1238.

View Entry 1866 James Wilhite v. Emeline Hickey Knox Land and Title Dispute

In Nov of 1864, Wilhite was arrested by US soldiers & taken to Knoxville, at which time Hickey was put in possession of Wilhite's land under lease agreement she had with William G. Brownlow, Special Agent of US Treasury Dept, appointed to take charge of & lease captured & abandoned property. Previous owner of the land (H.W. Swan) said to be a rebel. Land in dispute: 30 acres on Sevierville Road, 4-1/2 miles from Knoxville. Jury ruled for Wilhite.

View Entry 1931 J. B. & W. G. Brownlow, Agents for Leasing Company No. 1 v. Ressler Leather Company Knox Land and Title Dispute

Brownlows recovered judgment against Ressler for $430 & for possession of premises at No. 310 Wall Avenue in Knoxville, where proprietorship shoe repair business was located (known as Wall Avenue Shoe Shop). Shop at 1 point operated by Louis Friedman, brother-in-law of Fred Millen, who leased the premises from the Brownlows. Friedman had become indebted to Ressler, who allowed Millen's son Louis to operate the shoe repair shop until debt pd. Dispute over ownership of the shop.

View Entry 1918 James Gallagher v. Rock Island Memphis Railway Terminal Company& Chicago, Rock Island, Pacific Railroad Company Shelby Land and Title Dispute

2 folders. James Gallagher and Mary Ann Gallagher had title to land in Memphis. The railroad company tried to "purchase the property," but was "unable to agree upon the value." The railroad company stated that "the company had been given the right of eminent domain for the condemnation of private property." Mary Ann Gallagher is listed as "non compos mentis." James Gallagher is her trustee and was "to hold said property in trust for the purpose of securing a homestead for said Mary Ann."

View Entry 1874 Joseph Shoun v. William Shoun Johnson Land and Title Dispute

This case is for a the petition of a tract of land, 34 acres, in Johnson County owned by the complainant and defendant as tenants in common. The land was left to them by their father, Leonard Shoun. There was a small body of land adjacent to the 34 acres but instead of getting a grant they had the original tract of land surveyed in connection with 34 acres and obtained a grant to jointly tenant for entire tract of about 370 acres.

View Entry 1878 Lucinda Rowan v. John D. Riley and E. Beal Hawkins Land and Title Dispute

Over the course of several years the Rowan family engaged in litigation with John D. Riley over possession of a certain tract of land known as the "Beech Creek Bottom." The plaintiff received a judgment against Riley and regained possession of said land. Plaintiff now brings suit seeking back rent, damages, and the settlement of any questions related to boundaries. Exhibit materials include 2 small maps.

Plaintiff alleged that she purchased a tract of land herself, however her husband's name was included on the deed of the property. Plaintiff's husband, co-defendant T.B. Anderson, sold property to defendant. Sale was made without the permission of plaintiff. Plaintiff stated that sale was fraudulent and void, therefore property should be returned to her possession. Plaintiff is sues defendants to recover a 500 acre tract of land in the newly formed Houston Co (portion formerly in Stewart Co.) Plaintiff claims tract under a grant from the State of TN to Thomas D. Mackbee for 5000 acres dated 1838. Defendant claims land under TN grant to G.W. Bell and Henry Lockhart for 5000 acres in 1857. Both parties admit both grants cover the land in question. Bells heirs include: Benjamin Bell, Joseph Bell, Johnson Bell, Franklin Bell and Luella Bell.

View Entry 1855 Martha E. Stephens, guardian, et al. v. W. W. Porter, et al. Monroe Land and Title Dispute

Jacob Baker died intestate, his land then partitioned by the heirs, & H. Stephens, Martha's husband, appointed agent to sell the land. It was sold to Mr. Cleburne, who then sold to W. Porter. This suit sought to ify these sales of the land, & return it to the heirs. Martha was placed in an asylum, making her husband the heir to the land. However, the paperwork filed with the court initially left out Martha's incompetency, & therefore were faulty in naming the appropriate heirs.

In the original warrant, Minerva Hailey alleged that Tolberta Battle failed to comply with the terms of a contract of sale "of house and lot #913 S. Cherry St. made April 3, 1895." Mrs. Hailey alleged a "plea of debt by damages." Mrs. Hailey sold the home and lot via auction, however the buyer, Ms. Battle, refused the sale claiming the deed was not valid.
