Rent was $250 per yr., with clause if store destroyed, rent agreement would cease. The store burned down in 1880. Defendant claims there was no disaster clause & regardless, the original contract had expired & he is due rent for year 1880 of $320. Plaintiff had paid this as part of previous judgment, but appeals to have rent from date of fire returned. |

Pla. sought certiorari against def. for possession of land from their earlier unlawful detainer case. |

Saunders leased the house "for the purpose of keeping an immoral resort…" The Maydwells stated that the rent was due on the 1st of each month; Lizzie said the custom had been to pay rent when they sent for it. Saunders claimed that real reason Maydwells brought suit was so that Sophia could dispossess her in favor of Wm.'s girlfriend whom he "kept" at the house. |
