Plaintiffs claim the defendant attempted to repudiate the purchase of said lots when the Nashville real estate market went down. |

The contract for the exchange of real estate stated "that the witness would have ten days within which to inspect the property, but that on account of severe storms, he was unable to make said inspection." "He accepted the contract in full without inspection, and a notation of this acceptance was signed by him on the contract." Sometime later, when the property was examined it was found to be "not what it was represented to be." |

Mrs. Hailey alleged a "plea of debt by damages." Mrs. Hailey sold the home and lot via auction, however the buyer, Ms. Battle, refused the sale claiming the deed was not valid. |

After his death, the city had failed to comply with several stipulations laid out in the contract and deed, including not introducing water or having a fountain and maintaining the grounds and fence enclosing the property. |
