When the plaintiff forwarded the draft to the Lynnville Bank & Trust Co. for payment, it was protested by R. A. Mitchell, Giles County Notary Public, for lack of payment. |

O'Brien brothers had agreed to pay $125 for Simpson's horse. Sale was on a Sunday and horse delivered to them. Simpson did not take O'Briens' note because it was Sabbath and def'ts agreed to come back another day to pay for the horse, which they never did. They held onto horse for unreasonable time without asking to return it to Simpson but then the horse died. Simpson sues for $130.98 in damages. Def't call for new trial, which is refused, and then they appeal. |
