John Gass, was legislator for a number of years & married a younger woman following the death of first wife. Following an injury from a horse riding accident, his heirs accused him of being mentally feeble. They sued because they wanted to void his will.

Origin of debt: unknown.

Complainant acting in the office of County trustee received money. Before Complainant could put the money into the Bank, it closed. Complainant prays that the court issues an injunction restraining the defendants from demanding the money with interest.

The plaintiff claims that the defendant removed railings from said fence to construct his own fence. Partial record. Transcript of the record. "Appeal prayed at October Term, 1857." "A plea of trespass on the case by throwing down a fence and turning out his meadow & wheat field to the public to his damage fifty dollars."

Susong claimed Allen instructed his black man to throw down Susong's fence (which he did) & Allen went through his field with a wagon, causing damage. Susong had extended a corner of his fence over an old public road that people used in bad weather (when main road was muddy). Witnesses: pla.'s son William A. Susong, Def's nephew Samuel Allen. Lots of testimony about the history of the old road.

Cause of action was listed as "debt due by contract." The amount owed was listed as $131.91 .

Plaintiffs seeks to regain possession of a pair of cows. Exhibits include cancelled checks. Add. Defendant: Roy Craig.

Additional Defendants: Sam Riley & W. T. Bond, admr. of estate of H. E. Kirk, Melvin Kirk's father. Bussler sues defendant for $5000, charging that ca. 23 May 1934 he was struck by a car driven by Kirk and seriously injured. Further alleges accident was caused by Kirk's negligent operation of the vehicle as he was intoxicated at the time & driving at a high rate of speed. Plaintiff seeks attachment of Kirk's car & his interest in his father's estate. Riley holds note on car.

This case was filed to determine if an ordinance of the town of Greeneville forbade licensed retailers from the sale of liquor between 6 o'clock pm and 6 o'clock am is valid. The ordinance was determined to be valid.

Exhibits: 3 - large calendars, bulletin, 2 - pamphlets from U.S. Department of Labor. Plaintiff sued for overtime compensation and an equal amount of liquidated damages.

Fowler says Farnsworth violently assaulted him by kicking & striking him, throwing him down, & dragging him, causing bodily injury & damaging his clothes. Farnsworth says he was justified in doing so, as Fowler broke into his house & he was resisting it. Fowler's children mentioned: Benjamin F. Fowler, Catharine Fowler, & stepson Alexander Simons. NOTE: ET 1140 and 1173 contain other cases between same parties around same time period, & cause of actions are fraud and trespass & damages.

Fowler and Farmsworth had been in court two previous times, one for fraud and another for assault. See ET 1140 and 1152. For this case, Fowler is sued Farmsworth for trespass and damages: for breaking apart, pulling down, and destroying various panels of fence, gates, and drawbars; conveying, damaging, or carrying away $200 worth of wheat; and cutting up, destroying, and spoiling herbage for his livestock. Fowler sues for $1000 in damages.

Defendants were merchants dba A & J Stonecifer who owed a $254. 06 debt to Brown, and sued to collect said debt.

Consolidated cases. C.M. Brannon sued the estate for $8212.50 debt for personal services rendered to Harrell (to provide for her comfort and to nurse her throughout the night). Jennie Brannon for $3495 debt for 660 meals she furnished Harrell. Court ultimately ruled in favor of plaintiffs for $1085 each. Wilbur W. Piper, executor, appealed.

Plaintiff sued defendant for $2500 & interest, plus statutory penalty of 25% of the amount due. On Aug. 1935 plaintiff's left hand was accidentally severed above the right wrist by a saw. Doctors were able to reattach the hand, but it is essentially useless. Metropolitan Life has refused to honor the claim, although the plaintiff's policy was paid up & in force at the time the accident occurred.

Additional defendants: Thomas Wyatt & wife Nancy, Hampton McGill & wife Rebecca, and Mary Hollingsworth, heirs of Nancy Hollingsworth, dec. Williams sued Nancy and Mary Hollingsworth for ejectment to her damage $500. Williams also suing to recover tract of land.

Already convicted in 1868 for assault and battery of Samuel Lane. Incomplete case.

Damages of $1,000 due to business transaction made in Jan. 1858 whereas a bank draft, New York, payable to the order of Albert Merchant, $485.00 was transferred between parties, and that draft was deemed to be insolvent.

The plaintiff sought damages against the defendant for changing the course of a natural waterway that ran across his land. Case sought to assign water rights, as water had been diverted from one property to another. When the land was originally purchased by Rush, it supposedly included a waterway. However, since the water had been diverted it did no longer.
