Plaintiff in error and defendant in error are brothers. Plaintiff was surety on a promissory note for the defendant given to S. M. Alexander. The note was sued on and a levy was executed on a pair of mules owned by the defendant. The plaintiff purchased said mules at sheriffs sale and, according to the defendant, agreed to sell the mules and give to him any money over the purchase price. Defendant complains that the plaintiff now refuses to honor the contract.

View Entry 1889 Moore & Bobo v. Manly Manufactoring Co. Moore Damages

G. L. Moore and C. S. Bobo are the owners and operators of a livery stable. Plaintiffs note that R. P. Manly, representing the Manly Manufacturing Co., sought their services to travel from Lynchburg to Tullahoma. Plaintiffs complain that although the defendant was warned about rising creek waters, he attempted to pass through a creek using their horse and buggy. Crossing the creek resulted in significant damage to their property, and plaintiffs are seeking damages.
