In the operation of the soda fountain, he had to use a gas drum. He ordered a gas drum by telephone from the Moerlein Brewing Company but the order was filled by Blue Seal Ice Cream Co. When delivered, the deliveryman connected the new gas drum and it exploded. |

The defendants said the deed upon which is charged with having been guilty of a breach of warranty, conveyed said property belonging to the defendant and his wife, Achsah B. Anderson, and to the Anderson-Tully Co., a corporation. Court decision appealed. |
