This is an appeal. Original bill showed Shelly as plaintiff filing suit against Lipton, with William Garrison, James Rhea, Joseph Rhea & Garnet Rhea, for trespass with force & arms plus damages. May 1833, the group restrained Shelly and took 7 horses. In addition, goods & property were taken; the total value of stolen goods equals $1000, the amount Shelly sought for damages. |

Nail accused of entering McMillan's land, erecting a fence, & erecting a dam across Swan Pond Creek causing said creek to overflow & damage the land. Justice of Peace ruled for McMillan & awarded $25 damages, which Nail appealed to Circuit Court. Circuit court ruled in McMillan's favor & awarded $8 damages, which Nail appealed to SC. Nail tried to argue overflowing of McMillan's land caused not by Nail but by mill race conveying water to mill. |

The judgment rests on the boundary lines of army occupation during the events involved, relating directly to the value and viability of CSA money. |
