Fitzgerald was accused of the felonious and willful first degree shooting murder of Dorsey McMillan on Sept. 24, 1933. Fitzgerald appealed his initial conviction of 2nd Degree Murder. McMillan is variously spelled McMillian, McMilland, etc. Fitzgerald and McMillan got into a fight during a craps game, Fitzgerald came back with a shot gun and killed McMillan. |

McCracken originally found guilty of first degree murder in the shooting death of Ben S. Young, a whiskey dealer, on 22 Oct. 1892. Young lived about 3 weeks, died 19 Nov. 1892. McCracken argued that he fired in self defense. McCracken & Young had been arguing over rent. McCracken said rent payment was responsibility of Millard Crowe, who rented the shop from Young. (McCracken worked in the shop & had a room there.) Shop located above Young's saloon. Note: Mrs. Nannie Collier widow of Young. |

3 folders. Ware is charged with the murder of Ben Birdwell. "The homicide is shown to have been an unlawful one, committed by the defendant while under the influence of liquor, and as the direct result of hatred and animosity engendered by actions and conduct of the deceased during the afternoon growing out of a crap game." Ware and Birdwell were arguing over who won $200 in a crap game. Ware shot and killed Birdwell in an attempt to take the money. |

Defendant, victim & witnesses all African American school children: Oglesby 13, Tharpe, 11. Witnesses: Isola Smith & Beatris Tharpe, both 9 Dersie Sneed, 12 & others. Fight began when Oglesby insulted Tharpe's sister; Ogleby struck Tharpe with a stick. Defendant argued that he acted in self defense as Tharpe also had a stick & was about to strike him. |

There was an argument at a picnic in McLemoresville. Juel Bell was "afflicted on his right side." He had his hand in his pocket, around a closed knife. T. Foster shot Bell in the back and killed him. The dispute is self-defense, def. state Bell had knife The Memorandum for the State states that the witnesses for the victim were impartial, while Bunk Foster is not reliable. Alfred Taylor on Jan. 13, 1923 before the case was appealed. Exhibit includes a Pardon for Bud Greer signed by Gov. Taylor. Pardon states that he is a "man of exceptionally good character, industrious and well thought of." Transcript not included. Only includes Supreme Court briefs, no original case file. |
