According to witnesses, the defendant was in a heated exchange with a person named Brock who was a tenant on the defendants property. The defendant believed he was owed rent from Brock and had an attachment placed in the hands of Forrest Patrick who was deputized as a special officer. Patrick brought Brock to the home of Edmonson where the exchange occurred. |

Jury convicted Manse of unlawfully carrying weapon--called pocket pistol, belt pistol, revolver, Army pistol --and fined him $50. Having failed to pay or secure fine, Manse delivered to Keeper of County Workhouse until such time as he should by labor pay the fine. Witness Jo Manley (col): His house was broken into; he had reason to believe Manse did it; found Manse on Spruce St. & took him by the arm, at which time Manse pulled gun. Manse's mom Lau Bailey also testified. |

Issue was intent, as it's only a crime if def. had intent to go armed. James obtained a new trial because Circuit judge improperly charged jury that "it is no excuse if a pistol is carried solely for squirrel hunting." |
