Owen admr. for & father of Clopton Owen who, on 29 Sept. 1908, was struck and killed by a streetcar owned & operated by the defendant as he was walking home from school. Owen sued for $25,000 in damages. Owen charges negligence in that the motorman gave no warning of his approach & the street car was not equipped with a fender which, had it been present, could have prevented the injuries that took his son's life.
