Owen admr. for & father of Clopton Owen who, on 29 Sept. 1908, was struck and killed by a streetcar owned & operated by the defendant as he was walking home from school. Owen sued for $25,000 in damages. Owen charges negligence in that the motorman gave no warning of his approach & the street car was not equipped with a fender which, had it been present, could have prevented the injuries that took his son's life. Cora Brown mother of Pearl Brown, a minor; J. W. Brown her step-father. Plaintiffs sued defendant for $50,000, charging that on 31 Aug. 1910, he abducted Pearl Brown without the consent of her parents "for the purpose of prostitution and concubine." Defendant states that the Browns had once lived on his place & that Pearl Brown asked for his help in escaping her step-father's sexual abuse. There was a warrant for J. W. Brown's arrest on charges of incest in Tippah Co., MS. Volume 2 is in WT Box 1070. |

Recovery of a large, iron Diebold safe. The bigger issue: Olsen & Lesh was a construction company & claim that they were insured under the name "Olsen & Lesh," therefore, could not be sued under any other name. The defendant entered much proof that the company was called "Olsen & Lesh Construction Co." Glover argued that the company knew exactly who was being sued, no matter the misnomer. "Olsen" also spelled "Olson." |

Plaintiff originally sued defendant for $1700 damages, alleging that for 17 days in 1907 in violation of the law, the defendant knowingly & maliciously refused to furnish him with a telephone despite his having paid for the telephone in advance & having complied with all of the defendant's rules & regulations and all of the state's laws on the subject. Plaintiff won judgment of $850, seeks to recover full amount. Opinion included. |
