Estoppel. In 1914 Ford & Gooch went into the produce business. Russell Smith worked for them part of the time. Later in that year, Gooch went out of business and the name was changed to Ford & Smith Produce Co. Ford claimed that he did not have any particular Smith in mind- he just picked up the name and used it. Smith eventually left but Ford continued to use the name Smith on company letterhead, on signs in the door, etc.
