In 1892 William Newbern, an employee of the defendant, was struck by a train in the town of Clarksville. He died from the resulting injuries, leaving a widow and six children. Plaintiff brought suit for damages as the administrator of Newbern's estate. The defendant claimed Newbern was intoxicated at the time of the accident. Newbern earned $25 per month cleaning the defendant's "Princeton," train.
