Buckeye Marble (a foreign corporation) contracted with the defendant for the purchase of the whole and entire stock of the McMillan Marble Company (a Tennessee firm). Buckeye wanted the contract enforced. Harvey argued that Buckeye was taking advantage. "Can a foreign corporation come [into Tennessee] and swallow up one after another" the 10,010 domestic corporations for "such a nefarious and infamous intent and purpose?" Referred to is a suit against Buckeye in the death of William Shrum.
