Gillespie held occupancy on a tract of land and Mount held another tract. An agreement on an exchange of land was made between the two parties for mutual benefit. They drew a deed for Mount to pay Gillespie $7.50/acre for any extra land he acquires in the transaction with interest or a $2,000 penal sum. Mount has not paid any of the money due Gillespie for the extra land and Gillespie claims Mount is trying to cheat him out of land and money.
