In 1818, Richard Carpenter died leaving his property to his children & heirs. Included were 4 slaves, Lucinda, Ephraim, Patsy, & James. In 1833, defendant was appointed guardian of plaintiff and executed a bond with Thomas C. Porter with Samuel S. Smith his securities of his guardianship. Tomlinson then hired out the slaves for several years but never paid Tomlinson the money.
