McMillan sued Boyd for $1258.40 debt by note. Boyd had executed his note to Bankers Investment Company for $1100 as collateral security to a note made by Guaranty Trust Company to plaintiff for money advanced by plaintiff to said co. Because Guaranty Trust Co. failed to pay its note to plaintiff when due, plaintiff became owner of note made by defendant. Court ruled in favor of plaintiff for $1236.02. Defendant appealed.
