Curtis, as special commissioner for Luem Miller, exe. Of Nancy Officer, dec. against J.J. Mills et al. had obtained judgment against Gardenhire for $354.80 for alleged debt and damages. For this sum execution was issued against plaintiff and McMillan and placed in hands of Dawson, sheriff. Gardenhire charged that he did not owe the estate anything, but in contrast, the estate owed him as a lawyer $500 for his services in the case. Plaintiff wanted injunction against judgment.
