In 1835, the plaintiff signed as security on a note executed to the defendant for $130. The note was in the hands of the deputy sheriff. Later, the plaintiff notified the defendant to put the note in suit upon its maturity. But he did not and without the consent of the plaintiff, brought another suit against the principle of the note, Andrew Kirkpatrick and the plaintiff, for which judgment was rendered. This bill is an injunction to prevent further litigation against the plaintiff for the security.
