On 28 Aug. 1836 plaintiff deeded a tract of land in Washington Co. to Stout for $500, of which Stout has paid only $87. Plaintiff sued to collect the unpaid balance. At the time of the transaction Stout resided in Randolph Co., NC, but had given plaintiff the impression that he intended to settle on the land that he had purchased. Plaintiff later learned that Stout sold the land to Charles E. Kincheloe, & now believes that Kincheloe & Stout are involved in a plan to defraud Stout's creditors.
