J. A. Vaughn Sr. conveyed to the defendant a one-half interest in a tract of land for a price of $550. Complainants intestate purchased said land for the defendant J. L. Sain and paid the consideration price, with the understanding that J. L. Sain would repay this amount to J. G. Vaughn. Sain was to execute and deliver to J. G. Vaughn his promissory note and give a trust deed for one-half interest to secure the note. Sain never paid the consideration price "and that is still owing with interest."
