On 1 September 1927, the plaintiff and defendant insurance company entered into contract of insurance, $2,000/mo. payments should policy holder become disabled or incapacitated. Plaintiff later developed acute pulmonary tuberculosis, became totally disabled, permanently unable to perform any work. Insurance company failed to uphold their contractual agreement.
