"The bill in this case seeks to have a deed absolute on it's face construed as mortgage." On 10 March 1879, G. W. Sexton purchased from Gabriel Cooper, "the lot in controversy for the consideration of $250.00." On the same day, Sexton executed to H. H. Edwards, a mortgage on this lot. On 10 March 1881, Sexton conveyed to Cummings this said lot by an absolute deed for consideration of $230.00. A. P. Tompson, admr. for G. W. Sexton, dec. intestate 31 Dec. 1881.
