Burem filed the bill to enjoin the defendant from running/floating saw logs over his dam on Beach Creek about a mile above its mouth. Burem argued that Spears repeatedly caused a great deal of damage to the dam, and costly repairs had to be made by Burem. Spears argued he did not damage the dam and was within his right to float logs as the public had supposedly done for many years. Injunction was also against Samuel Miller and John Russell, employees of Spears. The creek empties into Holston River.
