Plaintiff Jobs sued the defendant railway company for $25,000 in damages for the wrongful death of R. S. Patty while a passenger on the defendant's train. The engineer urged Patty to get upon the engine with him for the purpose of showing Patty his skill at controlling the engine. Another employee neglected to close a switch and when the engine with Patty on it arrived at the open switch section of the tract, he and the engine were derailed and crashed into another train, killing Patty.
