Plaintiff is the administrator of the estate of L. R. Scudder (dec'd). In 1917, the deceased was walking on a path near the defendant's tracks, when an agent of the defendant negligently and carelessly at a rapid speed ran its railroad car upon and over the deceased. Plaintiff sued for $50,000 in damages for the careless act of the defendant closing part of the sidewalk to pedestrians to run its engines and forcing them to walk along a path where such an occurrence was possible.
