In 1870, Pltf's grandfather John O. Cooke sued Robert M. Cooke & others to vacate deed of gift. Pl (then 10) is only child of dad P.H. (now dec) & mom S.E. Cooke. S.E. employed Def (S.E.'s cousin) as their atty. Def received funds from 1870 suit on Pltf's behalf, which Pltf claims have not been fully paid over to him; hence this suit. Jones claims Pltf filed this suit to hinder Jones' election bid for attorney general, which he won in August of 1886.
