In December, 1921 J. W. Young sold 10 bales of cotton to E. M. McNamee. McNamee issued payment with two checks: 367.16 and 346.42. When Young deposited the checks at the Bank of Saulsbury, they were refused for payment. McNamee placed the cotton in the warehouse of the defendant and receipts have been issued in the name of Harris -Cortner co. for 8 bales and 2 bales in the name of Weil Bros. Complainant avers that he is the owner of the cotton and is entitled to full use of such.
