Plaintiff sued for $300 damages, alleging that in September 1848 Perkins seized his bay stallion valued at $300 & has since kept it for his own use. def.. Perkins argues that at that time he was acting Deputy Sheriff of Sevier Co. & Tipton was a Justice of the Peace. He took the horse to satisfy a judgment that Hugh Bogle, admr. of M. H. Bogle, dec., had recovered against Tipton on 7 Aug. 1848. Debt was for $17.03 plus cost of suit.
