Plaintiff is the administrator of the estate of John Willard Phillips, a minor (dec'd), who was employed by the defendant as a newsboy. He went in the elevator on their property to an upper floor when he was struck on the head by an abrupt projection of the wall of the elevator shaft, mangling his head and body between the steel frame and woodwork of the elevator and causing him to hang suspended in the shaft by a leg, all while conscious for a time. Plaintiff sued for $25,000 in damages.
