A William M. Ford purchased horse from Looney to go into Confederate cavalry. Ford issued note with Gilliam and others as sureties. Later, warrant issued upon note by Looney. No other notice given on the matter. Judgment and execution were rendered against Gilliam without his knowledge of any proceedings nor could he made an appeal from judgment. Gilliam applied for writ of certiorari.
