Hagerty sued for $25,000 in damages. Hagerty hired Hughes as a physician, to care for his wife, Mary, who was pregnant. Mary had been ill and faint. The Dr.Hughes used leeches, which he lost control of, and they entered her womb, allegedly causing further illness, the premature birth of her child, and death for Mary and the child. Hagerty worked for the gas company and had two children with Mary prior to her death. He sued on their behalf.
