Lawson purchased land from Vick with a $700 note. When due he was unable to pay and the land was put up for sale. When about to sell it was discovered that Vick had already sold a portion of the land to a John L. Jones, who never laid claim, but whose title diminished the land sale that Lawson owed on and was ordered to sell to repay the note. Lawson requested an abatement to reduce the purchase price and an injunction to halt Vick from attempting to recover the note until the true value was known.
