Jacob Philips entered a contract with John Burnley that would convey Burnley a lot of land. After making several payments, Philips told Burnley that he could not sell the land, until a grant could be procured from the State of Tennessee. In the mean time, John Haynes offered to buy the land from Philips, paying back Burnley his payment. Suit sought to settle rightful ownership to the land.
