Defendants had bought a tract of land for $1200; $500 cash in hand and $700 in 7 notes of $100 each. Plaintiff was the brother of M.J. Clayton. 5 of the notes defaulted and the original owner, John B. Nall, filed suit against def., enforcing his vendor's lien. Pla. paid Nall with M.J.'s promised to repay him, which she never did.
