In 1882, Charles McCrohan, deceased, allegedly got off the train in Cleveland, TN under the influence of "whisky or morphine." He reboarded the train but having no ticket or money was put off at Charleston where witnesses saw him wandering near the tracks and platform late in the night and early morning hours. He was hit by a train as he walked and died of his injuries soon after. Whiskey and morphine bottles were found on the deceased. The plaintiff sued and was awarded damages of $4500 prior to appeal.
